How giving credit is regulated

Credit provided to Australian consumers is regulated by the National Consumer Credit Code (the National Code). This replaces old laws, including the Uniform Consumer Credit Code, which applied in each State and Territory but was administered separately in each.

The new laws have a wider coverage, that is, more types of credit contracts are dealt with. In addition, credit providers now have an obligation to ensure the contract is not unsuitable for the consumer, for example, where the consumer will be unable to meet the repayments. These rules are known as the responsible lending conduct obligations.
